Proposed Cannabis Land Use Ordinance

The County of Santa Barbara is in the process of developing comprehensive cannabis regulations for activities associated with the Medicinal and Adult Use Cannabis Regulation and Safety Act (MAUCRSA). These ordinances would potentially provide for cannabis cultivation, manufacturing, distribution and sale in Santa Barbara County.

With respect to Montecito, the preliminary draft ordinances would allow for cultivation and limited manufacturing in the Agriculture I (AG-I) zone district. In Montecito, this area is located between North Jameson Road and San Leandro Lane along Tiburon Bay Lane. The proposed ordinance does not allow retail sale or other cannabis related activities within our only commercially zoned area, the Neighborhood Commercial zone district (Montecito’s Upper Village), but this distinction is only preliminary and is subject to change. Within residential zone districts, personal use, defined as “The cultivation, harvest, drying, or processing plants with the intent to possess, smoke, or ingest cannabis or cannabis products for their own individual use” would be allowed by right, as mandated by State law. The draft ordinance includes limitations on this use, including: 1) Only adults 21 years or above may use and grow cannabis for personal use within a private residence; 2) Personal growing of cannabis is limited to six plants per private residence; and 3) Any outdoor cultivation shall be completely screened form view of any public area. The County intends to prepare an Environmental Impact Report (“EIR”) to evaluate the potential environmental impacts associated with the proposed regulations. A Notice of Preparation (NOP) and a Scoping Document that describes the areas to be evaluated in that EIR are now available. You can find these documents at the link above. The public is invited to comment on the scope of review in writing by 5 pm on August 11, 2017 or at a Scoping Hearing to be held on Wednesday, July 26th at 5:30 pm in the Board Hearing Room, Fourth Floor, 105 East Anapamu Street, Santa Barbara.

The Montecito Association has not yet taken a position on the potential ordinances. On September 5th (meeting starts at 4 pm), the County of Santa Barbara will provide a presentation to the Land Use Committee on the potential ordinances.
